CAT Tracks for January 6, 2011
SCHOOL LAW ALERT |
Madam President received the following this week...
As for "Care of Students with Diabetes"...
You should remember/review existing contract language between the Cairo Board of Education and the Cairo Association of Teachers...which should STILL remain your guideline:
No employee--except a certified nurse--shall be required to store or administer medication to students. Students shall be referred to proper, designated medical or administrative personnel for this function. The employer shall indemnify and save harmless from any liability any employees who administer medication to students in direct response to an order from supervisory personnel to do so.
Bottom Line: You should "Just say NO" to administering medications to students. If an administrator should order you to do so against your will, get a witness and preferably get the order in writing - AND - REPORT IT IMMEDIATELY to your CAT representative! Volunteer at your own peril...and against the advice of the IEA legal department!
As for FOIA Exemption...
This is a good thing...keeps your evaluation confidential. As you have read in CAT Tracks, newspapers have taken to "exposing" teachers...publishing their ratings for all to see. (As you have also read, these ratings are NOT valid or reliable and therefore are not worth the paper they are printed in/on. BTW...as the "public" complains about teachers hiding...what about doctors, lawyers, plumbers, carpenters, cab drivers, burger flippers, cashiers, politicians, etc. How many of THEIR evaluations have you seen printed in the paper? Hmmm...)
As for "Substitute Teachers"...
I'll let those less fortunate than I worry about that!
