UPDATE...JAMES GIBSON VS. CSD #1

Yesterday I received a copy of the 12-page "Final Order" of the Illinois Educational Labor Relations Board issued on January 21, 2011 in which the IELRB UPHELD the 27-page "Recommended Decision and Order" (RDO) issued by the Administrative Law Judge (ALJ) on April 9, 2010 as a result of an IELRB hearing that she conducted on October 27 and 28, 2009.

I read it... ...and it was good!

To give you a taste...

The "cover page" listing the official case names (four cases rolled into one):

If you thought that my opening paragraph was "windy", with a hint of "legalese", you should read the document itself. (Guess that's how the District's lawyers earn their $160,000 per year!)

I settled on a "footnote" for your viewing pleasure:

As background for the above, lawyers for CSD #1 (in their appeal of the ALJ's decision against them) had chosen to attack the Judge...for her findings of fact and her determination of the credibility of witnesses who testified before her. In their footnote, the IELRB notes that the ALJ was at the hearing, the ALJ saw and heard the witnesses, the IELRB was not/did not, and that there was nothing in the record to indicate that she had erred.

APPEAL DISMISSED!!!

Notice of right to appeal:

Cairo School District Number One has 35 days to file an appeal to the Appellate Court of the judicial district in which the Board maintains an office (Chicago or Springfield).

(CAT Tracks Editor's Note: Oops, my bad! In my earlier post, I had indicated that should Cairo School District Number One choose to go for "Strike Four" - to appeal its failed appeal of its failed hearing following its failed arbitration - that "the final game" would be held in the Alexander County Circuit Court. Seems that I committed a faux paw! "Next Stop" would be either Chicago or Springfield! BTW...Cairo employees have an outstanding record in those locales as well...CAT earning a split decision in Chicago, CAESP winning outright in Chicago, and Lorenzo Nelson using a private lawyer to trounce the District's "hired gun" in Springfield.)

Bears repeating...

CSD #1 Officials:

It's time...waaaaaay past time!

STOP THE MADNESS!!!
